1. Acceptance of Terms
By accessing or using BeInMotion, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the application.
2. Description of Service
BeInMotion is a personal season companion for sport, available on iOS and Android. The app allows you to:
- Grow Moe, your seasonal companion, through the sport hours you put in during the calendar year, and keep every earned form in your collection
- Track your training balance across endurance, strength, mobility, coordination, speed, and core with the sport-mix hexagon
- Build a personal world map from your activities, discover new routes with AI route discovery, create your own routes, and follow them with turn-by-turn navigation
- Import workouts from Apple Health, Google Health Connect, Garmin Connect, or activity files (GPX, TCX)
- Create videos with telemetry overlays (heart rate, speed, elevation, route, and more) in the on-device video editor and export them in various formats and resolutions
BeInMotion is under active development. Features may be added, changed, or removed as the product evolves.
3. Account Registration
Core features work without an account. Cloud sync of your season progress, world map, and routes requires an account. When you create one, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
4. Free Tier, Subscriptions and Payments
4.1 Free and Pro Features
BeInMotion offers a free tier and a paid Pro subscription. The free tier includes the world map, Moe season, sport mix, collection, the full video editor, and 3 video exports; AI route discovery is limited. Pro unlocks unlimited AI route discovery, unlimited route creation, turn-by-turn navigation, unlimited video exports, and 4K resolution. The scope of each tier may change as the product evolves; the current scope is always shown in the app and on our website.
4.2 Subscription Terms
- Pro is available as a monthly (€4.99/month) or yearly (€29.99/year) subscription, billed through the Apple App Store or Google Play
- New subscribers receive a 7-day free trial; you can cancel during the trial at no charge
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- You can manage and cancel your subscription anytime in your App Store or Google Play account settings
- Refunds are handled by Apple and Google under their respective store policies
4.3 Price Changes
We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle. Statutory withdrawal and cancellation rights remain unaffected.
5. Health and Safety Notice
BeInMotion is not a medical device and does not provide medical advice. Metrics, season progress, and training balance indicators are for informational and motivational purposes only. Consult a physician before starting a new training program.
When using routes and turn-by-turn navigation, you remain fully responsible for your own safety. Always observe traffic rules, local regulations, terrain conditions, and your own abilities. Suggested routes may be inaccurate, outdated, or unsuitable for your activity.
6. User Content
6.1 Your Content
You retain all rights to the videos, images, and activity data you create or import using BeInMotion. We do not claim ownership of your content. Videos are rendered on your device and are never uploaded to our servers.
6.2 Content Responsibility
You are solely responsible for:
- Ensuring you have the rights to use any content you import
- The legality of content you create and share
- Backing up your content (we are not responsible for data loss)
7. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use BeInMotion for personal, non-commercial purposes.
You may not:
- Copy, modify, or distribute the application
- Reverse engineer or attempt to extract source code
- Use the application for illegal purposes
- Sublicense or transfer your rights to others
- Use the application to infringe on others' rights
8. Intellectual Property
BeInMotion, including its design, features, the Moe companion and its artwork, and all other content, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.
9. Third-Party Services
BeInMotion integrates with third-party services such as Apple Health, Google Health Connect, Garmin Connect, the Apple App Store, and Google Play. Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services.
10. Disclaimer of Warranties
BEINMOTION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the application will be error-free, uninterrupted, or meet your specific requirements. This does not affect mandatory statutory warranty rights.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of BeInMotion, including but not limited to:
- Loss of data or content
- Loss of profits or revenue
- Equipment damage
- Personal injury during activities or while following routes
Nothing in these Terms limits liability for intent, gross negligence, or injury to life, body, or health where such limitation is not permitted by applicable law.
12. Indemnification
You agree to indemnify and hold harmless BeInMotion, its affiliates, and their respective officers, directors, and employees from any claims arising from your use of the application or violation of these Terms.
13. Termination
We may terminate or suspend your access to BeInMotion at any time, with or without cause, with or without notice. Upon termination, your right to use the application ceases immediately. You may stop using the app and delete your account at any time.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes through the application or via email. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. If you are a consumer, the mandatory consumer protection provisions of the country in which you reside remain unaffected. The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr/. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
